URGENT Request for Case Data to Support INCREASED INSURANCE MINIMUMS

Posting this request from ATAA for awareness.

ATAA urgently requests your help providing settlement data by December 20, 2023, to help set the groundwork for increasing commercial vehicle insurance requirements.

The U.S. Department of Transportation’s Volpe Center is researching financial responsibility standards for motor carriers. As part of a recent interview with the Volpe and the FMCSA, Joe Camerlengo and I met with Volpe and the FMCSA and expressed concern about the increasing incidences of underinsured motor carriers. We were told that some industry groups still argue that high-award crashes rarely occur (although they also argue there are an increasing number of “nuclear” verdicts). They asked if we could provide supporting data and we agreed to supply data on settlements at or over $750,000 to include in the Volpe report. This chance to add to this report requires our timely response.

We have engaged consulting firm Tuck Group to collect and analyze settlement details from 2017-present, including:

  • Attorney name and contact info
  • Was it a verdict or settlement?
  • Verdict or settlement amount
  • State
  • Year

If you have just one or a few cases, you can CLICK HERE for a simple survey. If you prefer using a spreadsheet, which works well especially if you have many cases to submit, CLICK HERE TO DOWNLOAD SPREADSHEET which is also attached. Understanding confidentiality, party name and other fields are optional. If unable to access the tools, reply to this email for assistance.

By promptly contributing your settlement and verdict data, we can significantly influence stronger legislation governing insurance minimums. Expect further outreach urging your response ahead of the December 20 deadline for inclusion in the report. We appreciate your efforts supporting this crucial initiative for safety and accountability.

We appreciate your efforts supporting this crucial initiative for safety and accountability. We will receive the data automatically if you fill out the simple survey. If you choose to fill out a spreadsheet, return the completed data to [email protected]. Thank you!
